Before you register with WILDCARD, you must read and agree to this Terms of Service (“TOS”). By using the WILDCARD services (the "Service"), you agree to be bound by the TOS and you agree that it is enforceable as if it were a written negotiated agreement signed by Spadetacular Interactive Pte. Ltd. ("Spadetacular Interactive") and you. Spadetacular Interactive may, in its sole discretion, modify or revise the TOS at any time without notice to you, and you agree to be bound by such modifications or revisions. Unless explicitly stated otherwise, any new features that augment or enhance the current Service shall be subject to the TOS. WILDCARD is a web-based Interactive Customer Relationship Management (iCRM) application from Spadetacular Interactive (the "Service"). Your use of the Service is at your sole risk. The service is provided on an AS IS and AS AVAILABLE basis. You understand that your content may be transferred unencrypted over the internet.
You must be at least thirteen (13) years of age to use this Service. You must provide your current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service. You are responsible for maintaining the confidentiality of your Service password and account, and are responsible for all activities that occur thereunder. Spadetacular Interactive reserves the right to refuse service to anyone at any time without notice for any reason.
You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to: use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably determined by Spadetacular Interactive; use the Service for any fraudulent or inappropriate purpose; resell, duplicate, reproduce or exploit any part of the Service without the express written permission of Spadetacular Interactive; use any robot, spider, other automated device, or manual process to monitor or copy any content from the Service. Violation of any of the foregoing may result in immediate termination of this Agreement, and may subject you to state and federal penalties and other legal consequences.
You agree that you will be solely responsible for the activities carried out with your account. Spadetacular Interactive is not responsible for any loss of income, loss of properties, dispute with customer.
WILDCARD determines its subscription fee by pricing band, based on the number of ACTIVE members registered under our client’s account.
WILDCARD offers 2 kinds of payment terms: monthly and yearly. Monthly Terms: A valid PayPal account is required to continue using the Service after the 3 months free trial period on a monthly basis. The service is billed in advance on a monthly basis and is not refundable. Yearly Terms: A valid PayPal is required to continue using the Service after the 3 months free trial period on a yearly basis. The service is billed in advance on a yearly basis. You may request for refund if you do not wish to continue using our service. Spadetacular Interactive will refund all unused month, excluding partially unused month, between account closure date and the final service date. We will not be responsible for paid taxes and duties imposed by governing authorities.
Spadetacular Interactive reserves the right to change Service fees upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the WILDCARD Site (www.wildcardapp.com) or the Service itself.
If you wish to discontinue using our Service, you may close your account by accessing account setting under “My Profile” link. The account setting page has a “Close Account” button. The closure is immediate and all of your Content will be deleted from the Service upon cancellation. There will be no refund if you cancel the Service before the end of your current, paid-up month. No cancellation fee will be charged. Email or phone request is not considered cancellation. Spadetacular Interactive may at any time and for any reason terminate the Services, this Agreement, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system.
Spadetacular Interactive owns all rights, titles and interest in and to the Service, including and without limitation all Intellectual Property Rights, and such rights are protected by Republic of Singapore and international intellectual property laws. You agree that you will not copy, reproduce, alter, modify or create derivative works from the Service. You also agree that you will not monitor or copy any content from the Service. Spadetacular Interactive claims no intellectual property rights over the data provided by you to the Service.
As part of our service, you will receive email, newsletter and update from us. If you no longer wish to receive our email updates, you may unsubscribe by clicking “Unsubscribe” link at the end of each email communication.
We follow generally accepted industry standards to protect the information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

At Applay, we are committed to respect your privacy and to safeguard the personal data of our customers that we may collect in connection with our mobile app- Wildcard loyalty app and website. Hence, this document will provide the information to better let you understand on how your personal data is managed.
APL collects personal information so that we can provide an experience that is responsive and customized to your needs to heighten customer experience for the loyalty programme or website visit. Examples of personal information we collect include, (but not limited) to the following:
a. Personal data about your details which may include names, identification particulars, bank account details (e.g for interbank payment purposes), date of birth, contact details, E-mail addresses, and transaction records (e.g customers’ redemption activities).
b. Information and data generated in the course of any continual relationship with APL, for example, instructions given by you to generate and launch promotion mechanics, sales report, analytics, back-end updates and rectifications of your customers’ records for loyalty programmes.
c. Information from cookies, other technologies deployed for the analysis of website usage or other information technology applications used by APL.
ALP will contact you regarding products, services, upcoming events, promotions, advertising, marketing and commercial materials which we may feel interest you;i. to ensure that the content from our website is presented in the most effective manner for your and for your computer and / or device; andii. APL will send e-newsletters to customers via email, where opt-out subscription is permissible.iii. Push notifications of stores’ promotions to your phone, where customers have option to inactivate the service via their phones.
Services we provide to our customers may be provided by us directly or through third parties such as web hosting services, our affiliates or other third party service providers who may be located within or outside of Singapore. Disclosure of your personal data to such other parties may be necessary in order for us to provide you with the services such as performing functions such as web solutions and app development, payment and hosting of domains. There would be appropriate contractual provisions in place to safeguard the confidentiality of your personal data, to ensure that the third parties only use the personal data to perform necessary tasks and not for other purposes.
Your Personal data will not be sold, transferred or conveyed to non-affiliated third parties. As soon as reasonably practicable, we will retain your personal data for as long as required to fulfill the role in which it was collected for. Should you choose to unsubscribe from our mailing list, please note that your Personal Information will still be retained on our database although we will cease to send you any further communications.
